This terms and conditions document governs the use of KiwiNordic’s Online Service (the Service). The KiwiNordic website is owned and operated by KiwiNordic AB, a private limited company based in Gothenburg, Sweden.
Acceptance of Terms and Conditions: By accessing, browsing or using this site, you acknowledge and agree to the terms and conditions, as well as any relevant disclaimers contained herein. Further, by continuing, you acknowledge that you have read, understood and accepted these Terms and Conditions. By purchasing a product from this website, you agree to be bound by these Terms and Conditions.
KiwiNordic reserves the right to change any or all of the information contained herein at any time and you should constantly check the current terms and conditions. KiwiNordic reserves the right to refuse service, terminate accounts, remove or edit content or cancel orders at their sole discretion. Any orders cancelled by KiwiNordic, but paid for, will receive a full refund.
Purchasing: To purchase from this site, you must be sixteen (16) years of age or over.
Pricing: All prices in the shopping areas are in New Zealand dollars (NZ$) and include GST (12.5% sales tax). All prices are correct at time of publication, however we reserve the right to alter prices for any reason. If this should happen after you have ordered a product, we will contact you prior to processing your order.
Security: It is natural for those new to electronic purchasing to be concerned about security of personal and credit card details. In reality, a commerce transaction on the Internet is significantly more secure than a similar telephone transaction or handing your credit card over the counter in a store. When you make purchases using our secure online credit card facility(Dibs Payment Services), you can be confident that all of your details are protected by the latest security mechanisms and are used only for the purpose of the transaction fulfillment. For the actual transaction you are automatically moved to Dibs own website where your card details are registered and handled. KiwiNordic AB does not have any access to your card details at any stage in the transaction.

Errors and Omissions: We are not responsible for any typographical errors or inaccuracies set forth in this website. The information, prices and discounts set forth herein are subject to change without notice. If there are any changes after you have ordered a product, we will contact you prior to processing your order.
Prohibitions: Please ensure you do not knowingly transmit any material that may contain a virus or other harmful component. Only individuals who can make legally binding contracts may purchase goods and services from this site. KiwiNordic cannot guarantee that it will notice or be able to prevent any illegal or inappropriate use of this website, nor can KiwiNordic guarantee that it will give notice of any illegal or inappropriate use of this website.
Electronic Communications: When you visit www.kiwinordic.com and you send e-mails to us, you are electronically communicating with us. By doing so you consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on this site.
Orders: By placing an order on this website you agree to and accept the terms and price specified in this web site. This price may include additional delivery and other applicable charges. This offer may be accepted or rejected by KiwiNordic for any reason, including, the unavailability of any product, an error in the price or the product description posted on this web site, or an error in your order. Your contract with KiwiNordic will only come into existence when you have fully paid for your order and KiwiNordic provides confirmation that your order has been accepted. Confirmation will be sent via email to your elected email address.
Fraud Protection Program: As part of our order processing procedures, we screen all received orders for fraud or other types of unauthorized or illegal activity. We reserve the right to refuse to process an order due to suspected fraud or unauthorized or illegal activity. If such is the case, we may reject your order or Customer Services may call you at the phone number you provided to confirm your order. We also reserve the right to cancel any accounts or refuse to ship to certain addresses due to suspected fraud or unauthorized or illegal activity. We take these measures to protect our customers as well as ourselves from fraud or other unauthorized or illegal activity.
Risk: KiwiNordic will retain ownership of the products you order until you have made payment in full for those products, but all risk in the products will pass to you on dispatch from KiwiNordic AB or its local point of dispatch.
Loss or Damage in Transit: KiwiNordic will take every care in packing and dispatching your purchase but is not responsible to the buyer or any person claiming through the buyer for any loss or damage to goods or products caused by any event of any kind by any person, whether or not KiwiNordic is legally responsible for the person who caused or contributed to that loss. KiwiNordic is not responsible for any loss of items that are wrongfully signed for and accepted by a third party.
Exclusion of Negligence: KiwiNordic is not liable to the buyer in contract or in tort arising out of, or in connection with, or relating to:
(a) the performance of the product;
(b) any fact, matter or thing relating to the products; or
(c) any error in information supplied to the buyer or a user at or after the date of the purchaser's or user's use of the product.
Delivery: We will endeavour to send your goods at the postage/courier rates indicated, however, if your order is particularly heavy or bulky , we may be charged more from our freight provider and as such, this additional charge will be passed on to you. Before processing any heavy or bulky orders incurring freight up charges, we will contact you first to see if we can arrange collection or delivery using different means.
Delivery times given on this web site are indicative only. Your order will generally be dispatched from our logistics provider in Auckland. Some products however may be dispatched direct from our suppliers in the Nordic Region (Sweden, Norway, Denmark or Finland) KiwiNordic will not be liable for any failure to observe these delivery times but will try and contact you by phone or email if any late deliveries are anticipated. You understand and agree that you shall not be entitled to withdraw or modify any commitment made for the purchase of products from this web site once that commitment has been made for any reason, including without limitation, due to any delay in delivery.
If however, delivery has not happened after 30 days from the indicative delivery date, the buyer may, at their election, treat the failure to deliver as a terminating contractual event. In such an event KiwiNordic will refund any payment made to it in respect of that particular order.
If KiwiNordic is unable to source the particular product you require, KiwiNordic will contact you, the buyer, and inform you of the general date of availability. If you, the buyer, are unhappy with that, KiwiNordic will provide a refund of the money paid for that order.
Returns Policy for Website Purchases: We guarantee money back refund if you are not 100% happy with your purchase. Products will need to be returned to the logistics center in Auckland, in their original condition packaging and with KiwiNordic’s packing slip. Notification of a return needs to be made to KiwiNordic (info@kiwinordic.com) within 5 days of receipt by you.
Once we have received the goods and ascertained that they and their packaging are still in a condition that they can be resold for full original retail price, you will receive a full refund less any courier and packaging charges. Any courier costs you incur to return product to us will not be refunded unless we have made an error. Courier costs are generally non refundable for undelivered, unclaimed or returned packages unless we have made an error.
We regret we cannot offer a refund or exchange for any products listed on the site www.kiwinordic.com once the product has been used or tampered with, or if the packaging has been damaged to the extent that the item is no longer saleable for its original full price.
If there is any defect in the product on receipt, once opened, then it may be returned to us for exchange or a refund at that time. Please e-mail us at info@kiwinordic.com and advise us of the problem. We will inform you of what needs to be done to arrange the refund. You must make notification to them within 5 days of receipt.
Cancellation & Modifying Orders: You can view the contents and the total amount in your shopping cart before you place your order with KiwiNordic. Once your order has been submitted successfully you will receive your order confirmation via email. Your order will then enter the courier process almost immediately. Once your order is in the courier process, no further changes can be made to the order. A separate order will need to be completed should you wish to add any additional products. Should you wish to cancel your order altogether once you have received your Order Confirmation Email and entered the courier process, you must contact us immediately. Depending on what stage of the packing and dispatch process your order is at, KiwiNordic reserves the right to deduct a 10% handling and administration fee.
Consumer Guarantees Act: All purchases from this site are covered by the New Zealand Consumer Guarantees Act 1993 which guarantees that any goods purchased for personal use may be returned, if they are not of an "acceptable quality" (for example, if they are not fit for the purpose for which they are bought, or if they are unsafe). If a person returns goods in terms of this provision, KiwiNordic is entitled to provide a refund or a replacement product within a reasonable period of time.
Termination: Your ability to purchase products and services from this web site may be terminated at any time by KiwiNordic without notice. All disclaimers and limitations of liability by KiwiNordic will survive termination. Should you object to any of these Terms and Conditions, including any subsequent amendments, you must immediately discontinue use of this site.
3rd party Advertising, Hyperlinks and Offers: The site may have third party advertisements, referral buttons and other pointers to websites operated by third parties. KiwiNordic has no control over these sites and is therefore not responsible for any materials and contents linked to our website. While this information is offered in good faith, it must be understood that KiwiNordic does not necessarily endorse any of these sites or their advertising and is not responsible for any goods you purchase from them.
Colour Information: While KiwiNordic has endeavoured to display accurately the colours of products, the actual colours you see will depend on your monitor and may not be accurate.
Product Descriptions: KiwiNordic and its supplier's attempt to be as accurate as possible in describing products detailed on the site www.kiwinordic.com . However, KiwiNordic AB does not warrant that product descriptions or other content of this site is accurate, complete, reliable, current, or error-free. If a product offered by KiwiNordic AB itself is not as described, your sole remedy is to return it in an unused condition, for refund of the purchase price. The cost to return courier these products to us will be at your expense.
Governing Law: The laws of New Zealand govern any contract arising out of this website (with delivery to any address within New Zealand), and all disclaimers, terms and conditions and terms of use.
Disclaimers and Limitation of Liability: You, the customer expressly agrees that use of www.kiwinordic.com is at your sole risk. Neither KiwiNordic AB, nor any of their officers, directors, franchisees or employees, agents, third-party content providers, merchants, sponsors, licensors (collectively, "Providers"), or the like, warrant that KiwiNordic.com will be uninterrupted or error-free; nor do they make any warranty as to the results that may be obtained from the use of KiwiNordic.com, or as to the accuracy, reliability, or currency of any information content, service, or merchandise provided through KiwiNordic.com.
This site is provided by KiwiNordic AB on an "as is" and "as available" basis. KiwiNordic AB makes no representations or warranties of any kind, express or implied, as to the operation of the site, the information, content, materials or products, included on this site.
KiwiNordic AB reserves the right to change any advertised price before accepting an order. All products are subject to availability and may be withdrawn at any time. If we are unable to fulfill your order, you will be offered an alternative or given a refund for the unavailable product.

If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
